VIVARIA BUDGET, LLC ("We" or “Our” or “VIVARIA BUDGET”) respect your privacy and recognize the importance of protecting the privacy of all information provided by users of our App and/or our website found at www.vivariabudget.com (the “Site”), recipients of our email newsletters, and all other customers of our products and services. We are committed to protecting it through our compliance with this policy.

This policy describes how we may collect, use, maintain, protect, disclose, transfer, store, retain or otherwise process the information that you may provide when you (“you,” “your”) download VIVARIA BUDGET through a relevant app store and sign up for a VIVARIA BUDGET account and other services through the App or online at www.vivariabudget.com (collectively, “Services”). 

This Privacy Notice applies to your use of our Services via our App and our Site and covers only information collected in connection with your access to and use of our Services. This Privacy Notice does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party (including any of our affiliates and/or subsidiaries); or any third party (including our affiliates and subsidiaries)], including through any application or content (including advertising) that may link to or be accessible from or through our app and our Site. Children Under the Age of 16

Presently, our App and Site are only to be sued by persons who are at least the age of 13 years old.  While we believe that learning to maintain a realistic budget is a critical life skill that is best learned early, no one under the age of 13 should provide any personal information to us on or through our Site or App. If you are under the age of 13, please do not use our Site or App, contact us through our Site or App, or provide us with any information about yourself, including your name, address, telephone number, email address, or any screen name, user name or social media handle that you may use.  

 

If you are a parent or guardian and believe that your child is using our App and/or our Website, please contact us at 214-997-4513 or info@VivariaBudget.com. Before we remove any information, we may ask for proof of identification to prevent malicious removal of account information. If we discover that a child is accessing our App and/or our Website, we will delete his/her information within a reasonable period of time. You acknowledge that we do not verify the age of our users nor do we have any liability to do so.

This could include information that you provide to us in requesting that VIVARIA BUDGET contact you or provide you with information or services. When you purchase our services, we collect your first and last name, email address, physical address, credit card or other payment information, and other information listed.

Your search queries on our App and/or our Site.

When you setup a VIVARIA BUDGET ID, we collect your name, email address, and other information listed.

When you access and input information on our Sign Up Forms.

Our App and our Site may contain chat or contact forms that enable visitors to communicate with us live online or offline by email. In some cases, visitors can communicate with us without becoming a member or buying our products and services. When you use our chat software or contact forms, we may collect some or all the following information: your email address, first name, last name, location, and any other information you willingly choose to provide to us. You should limit the information you provide to us that is only necessary to answer your questions.

As you navigate through and interact with our App and/or our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

Some content or applications, including but not limited to advertisements, on the App and/or Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. We do not control third parties' tracking technologies or how they may be used. Third-party sources

We may receive personal information about you from other third parties where you have provided consent or where permitted by applicable law. We protect and process the personal information obtained from those third parties as described in this Privacy Statement, consistent with any additional restrictions imposed by the source of the information. Our third-party sources may vary over time and depend upon how you use VIVARIA BUDGET. For example, we receive information from:

• Linked third-party services.  You may choose to sync a bank account with your VIVARIA BUDGET account.  We use PLAID to facilitate secure sharing of specified banking information between your VIVARIA BUDGET account and your bank.  .  Plaid’s legal policies and terms of use will also apply to your use of our App if you connect your bank information.  For more information about Plaid’s legal policies, see https://plaid.com/legal/.  

• Customer support providers. We may receive personal information about you or your interaction with the VIVARIA BUDGET Platform from certain third parties for troubleshooting purposes. For example, we may obtain information about your interaction(s) with customer support and information about technical issues you have raised, including call center recordings, emails, call monitoring records, voicemails, photographs and chat records.

• Risk management, cybersecurity & anti-fraud providers. We may receive personal information from third parties that help us assess risks associated with our offerings, including to help combat fraud and illegal activity and to help protect your personal information.

• Data providers. We may receive information from information services and data licensors that provide demographic and preference information to us.

• Content providers. We may receive personal information from companies that make user-generated content from their service available to others, such as local business reviews or public social media posts.

To present our App and/or our Site and its contents to you.

To provide you with information, products, or services that you request from us.

We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. Promotional Offers from the Company. If you do not wish to have your email address or other contact information used by the Company to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to our Contact email set forth in this Policy.  If we have sent you a promotional email, you may send us a return email or unsubscribe asking to be omitted from future email distributions. 

Targeted Advertising.  We presently are not engaged in targeted advertising.  But, if in the future, we do engage in targeted advertising and you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by emailing us at our Contact email set forth in this Policy.  

We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Accessing and Correcting Your Information

If you wish to change or correct your contact information with us, you may send us an email at our Contact email set forth in this Policy to request access to, correct or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. Data Security

We have implemented measures designed to secure any personal information that is provided to us from accidental loss and from unauthorized access, use, alteration, and disclosure. Any information you provide to us is stored on our secure servers behind firewalls. 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our App and/or our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our App and/or our Site. 

 

Changes to Our Privacy Policy

It is our policy to post any changes we make to our Privacy Policy on this page.  If we make material changes to how we treat our users' personal information, we will notify you through a notice on the Site home page. The date the Privacy Policy was last revised is identified at the top of the page.
